TERMS AND CONDITIONS – SMART REPAIR SERVICES (UNIT-BASED)

1. Definitions
1.1 “Company” refers to Spankys Detailing Ltd.
1.2 “Customer” refers to the individual or entity requesting services.
1.3 “Vehicle” refers to the car or light vehicle presented for repair.
1.4 “SMART Repair” refers to Small to Medium Area Repair Techniques carried out on specific damaged areas of a vehicle.
1.5 “Unit-Based Pricing” refers to pricing calculated per repairable panel or damage unit rather than full vehicle restoration.


2. Scope of Services
2.1 The Company provides SMART repairs including but not limited to paintwork correction, scratch removal, dent repair, and cosmetic refurbishment of vehicle panels.
2.2 Repairs are limited to the agreed areas (units) only and do not extend beyond specified panels unless agreed in writing.
2.3 All work will be carried out at the Company’s premises unless otherwise agreed.


3. Estimates and Pricing
3.1 All estimates are based on visible damage at the time of inspection.
3.2 Additional costs may arise if further damage is discovered during repair. The Customer will be notified before proceeding.
3.3 Pricing is calculated per repair unit (e.g., per panel or localized area).
3.4 All prices are inclusive/exclusive of VAT (as specified in the invoice).


4. Colour Matching and Finish
4.1 The Company will take reasonable care to achieve the closest possible colour match using industry-standard techniques.
4.2 Due to factors such as paint age, weathering, and manufacturer variations, a perfect colour match cannot be guaranteed.
4.3 No blending into adjacent panels will be carried out.
4.4 As a result, there may be a slight colour difference between the repaired area and neighbouring panels, which the Customer acknowledges and accepts.
4.5 The Company shall not be held liable for minor variations in colour where blending has not been performed.


5. Customer Responsibilities
5.1 The Customer must ensure the Vehicle is available at the agreed time and location.
5.2 The Vehicle should be reasonably clean to allow accurate assessment and repair.
5.3 The Customer must remove personal belongings prior to repair.
5.4 The Company is not responsible for loss or damage to personal items left in the Vehicle.


6. Vehicle Risk
6.1 Any Vehicle left with the Company is left entirely at the Customer’s own risk.
6.2 The Company shall not be held responsible for loss, theft, fire, or damage to the Vehicle or its contents while on the premises, except where required by law.


7. Timeframes
7.1 Repair times are estimates only and may vary depending on complexity and unforeseen issues.
7.2 The Company will not be liable for delays caused by factors outside its control.


8. Payment Terms
8.1 Payment is due upon completion of the work unless otherwise agreed in writing.
8.2 The Company reserves the right to retain possession of the Vehicle until full payment is received.
8.3 Late payments may incur additional charges.


9. Warranty and Liability
9.1 The Company provides a limited warranty on workmanship for a period specified on the invoice.
9.2 The warranty does not cover:

  • Pre-existing damage
  • Normal wear and tear
  • Environmental damage (e.g., stone chips, UV fading)
    9.3 The Company’s liability is limited to the cost of the repair carried out.
    9.4 The Company shall not be liable for indirect, incidental, or consequential losses.

10. Cancellations and Amendments
10.1 The Customer must provide reasonable notice for cancellations.
10.2 The Company reserves the right to charge a cancellation fee where applicable.
10.3 Any changes to agreed work must be confirmed in writing.


11. Refusal of Service
11.1 The Company reserves the right to refuse or discontinue work if:

  • The damage is unsuitable for SMART repair
  • Health and safety risks are identified
  • The Vehicle condition prevents satisfactory repair results

12. Governing Law
12.1 These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.


13. Acceptance
13.1 By approving the estimate or booking the service, the Customer confirms acceptance of these Terms and Conditions in full.
